1. Introduction
The Federal Competition and Consumer Protection Commission (FCCPC) is a regulatory agency of the Federal Government of Nigeria responsible for promoting and protecting consumer rights and ensuring a competitive market environment. As part of its mandate, the FCCPC needs to engage a qualified consultant to monitor and supervise the activities of a leading product manufacturing company, hereinafter called the “company” to ensure compliance with relevant consumer protection laws and regulations.
2. Purpose of the Consultancy
The primary objective of this consultancy is to provide the FCCPC with independent and expert monitoring and supervision of the company’s operations, specifically focusing on their adherence to consumer protection standards, fair trade practices, and relevant regulatory frameworks. This will involve regular inspections, audits, and reporting to the FCCPC on the company’s compliance status.
3. Scope of Work
The selected consultant will be responsible for the following:
- Compliance Monitoring: Conduct regular and unannounced inspections of the company’s facilities and operations to assess compliance with relevant consumer protection laws and regulations.
- Data Analysis: Analyze data related to the company’s customer interactions, complaints, and service delivery to identify potential areas of non-compliance.
- Reporting: Provide regular reports to the FCCPC on the company’s compliance status, including any identified violations and recommendations for corrective actions. Reports should be submitted quarterly.
- Advisory Services: Offer expert advice to the FCCPC on matters related to the company’s compliance with consumer protection regulations.
- Investigation Support: Assist the FCCPC in investigating consumer complaints and allegations of non-compliance against the company.
- Capacity Building: Where necessary, provide training to the company’s staff on consumer protection best practices.
- Other Related Tasks: Perform any other related tasks as may be reasonably required by the FCCPC within the scope of this consultancy.
4. Deliverables
The key deliverables for this consultancy include:
- Inception Report: Detailing the consultant’s methodology and work plan.
- Regular Monitoring Reports: Quarterly reports on the company’s compliance status.
- Ad-hoc Reports: As required by the FCCPC on specific issues.
- Final Report: Summarizing the consultant’s findings and recommendations at the end of the consultancy period.
5. Duration of Consultancy
The duration of this consultancy is for one year with the possibility of extension subject to satisfactory performance and mutual agreement.
6. Consultant Qualifications
The ideal consultant should possess the following qualifications and experience:
- Demonstrated expertise in consumer protection and competition laws and regulations in Nigeria.
- Proven experience in monitoring and supervising businesses, preferably in a regulatory context.
- Strong analytical and reporting skills.
- Excellent communication and interpersonal skills.
- Relevant professional certifications (e.g., legal, auditing, engineering).
7. Proposal Submission Requirements
Interested consultants are required to submit a comprehensive proposal that includes the following:
- Company Profile: Detailed information about the consultant’s organization, including its legal status, experience, and expertise.
- Technical Proposal: A detailed description of the proposed methodology, work plan, and team composition for carrying out the consultancy.
- Financial Proposal: A detailed breakdown of the consultant’s fees and expenses.
- References: Contact information for at least three (3) clients for whom similar services have been provided.
8. Evaluation Criteria
Proposals will be evaluated based on the following criteria:
- Technical Expertise and Experience (40%)
- Methodology and Work Plan1 (30%)
- Financial Proposal (20%)
- References (10%)
9. Closing Date and Submission
Proposals must be submitted no later than noon on the 12th of February 2025 to the address specified above. Late submissions will not be considered.
